Reasons
Punishment of the crime
[criminal record] On November 12, 2015, Defendant A was sentenced to imprisonment with prison labor for a crime of fraud at the Seoul Eastern District Court on May 13, 2016 and completed the execution of the sentence.
[Criminal facts]
1. On December 22, 2016, the Defendant: (a) issued the forged US$ 100 2 joints of USD 100 (per $18,000) returned by L to the Defendant at the store near the Yeongdeungpo-gu Seoul Metropolitan City Daedong Station; (b) received the forged US$ 100 2 joints of US dollars (per $18,000) and sent it to money exchange; and (c) around the end of December of the same year, the Defendant issued the instant 10 US$ 2 joints of KRW 100 to the Plaintiff, who became aware of N’s introduction from the 9th floor coffee of the Jung-gu Seoul Metropolitan City MM building at the end of the same year.
Accordingly, the defendant issued a forged U.S. monetary 100 US dollars 2 composites to A and exercised it.
2. Defendant A’s criminal act was committed on or around the end of December 2016 at the 9th coffee shop of the above MM building.
Upon receiving a request from N to the effect that “I can find out whether I would have old US dollars” from E known to N, the above 100 US dollars was delivered, and around the 26th day of the same month, the P coffee shop located after Yongsan-gu Seoul Metropolitan GovernmentO stated that “I would like to find out whether I would have a large amount of US dollars,” and the above 100 US dollars was issued to B.
Accordingly, the defendant acquired forged US dollars 100 2 composites for the purpose of exercising, and exercised the above US$ 100 2 composites to B.
3. Defendant B’s crime
A. On December 26, 2016, the Defendant: (a) requested on December 26, 2016, that “A had a large amount of USD 100” from the above Pca shop, “A is asked to find out whether there exists any means of money exchange; (b) issued two consolidations of USD 100; and (c) was aware of the same day at R 2nd floor coffee shop located near Qu Station in Yongsan-gu Seoul on the same day.
