1. The Defendant’s reprimand disposition against the Plaintiff on December 26, 2013 shall be revoked.

2. The costs of the lawsuit are assessed against the defendant.

Reasons

1. Basic facts

A. On September 14, 2009, the Plaintiff began to serve as the team leader from the construction division of the city department in the Namyang-gu Urban Community.

B. On March 28, 2011, C filed an application for a building permit with respect to 16 households, a complex multi-family housing (hereinafter “instant multi-family housing”), located in the area of 1,672 square meters among 3,672 square meters of the area of 3,492 square meters, Nam-si, Nam-si, which is one of its owners, for a building permit, and the Defendant granted the said permit on June 27, 201.

C. On September 14, 2011, C divided the site portion of the instant collective housing No. 1 into 1,627 square meters in Namyang-si, Namyang-si, and divided the remaining part into E land, 27 square meters in F land, and 239 square meters in G land.

E. On November 3, 2011, the Plaintiff accepted the application for change of the title of the building permit of the instant multi-family housing No. 1, and approved the application for a building permit of the instant multi-family housing No. 2 on December 14, 2011, respectively.

F. On January 30, 2012, the Plaintiff terminated the work of the head of the building and B team, and was transferred to the head of the housing and H team.

사. 한편, C는 이 사건 제2공동주택에 대하여도 그 건축허가명의자를 다인엠앤큐로 변경하는 내용의 건축허가명의변경신청을 하였고, 그 신청이 2012. 6. 19. 수리되어 다인엠엔큐는 이 사건 제1, 2공동주택에 관한 건축허가명의자가 되었다.

H. The defendant shall obtain approval for a housing construction project plan in accordance with the Housing Act and the Enforcement Decree of the Housing Act for a person who intends to build at least 30 units of multi-family housing in a group of housing complex.
