The defendant's appeal is dismissed.

Reasons

1. The summary of the grounds for appeal (definite or misunderstanding of legal principles) did not have entered the intersection through yellow signal, and even if the Defendant entered the intersection in contravention of yellow signal, the signal immediately before the intersection is changed, so the Defendant cannot expect that he would stop at a considerable speed, and thus, the judgment of the court below convicting the Defendant of the facts charged in this case is erroneous by misapprehending the legal principles or misapprehending the legal principles.

2. In the case of paragraph (2) of Article 5 of the Enforcement Rule of the Road Traffic Act, attached Table 3, 1. Vehicles and horses shall make a yellow light; 1. Vehicles and horses shall, when there is a stop line or crosswalk, immediately stop immediately before or after the intersection; and when there are already entered the intersection, immediately stop out of the intersection;
