Reasons
1. Basic facts
A. The land cadastre of the land as indicated in paragraph (1) of this case (hereinafter “instant land”) is that C, who has a domicile in DNA, was assessed on July 5, 1912, and is not indicated the date of birth, specific address, etc. of the said C.
The instant land is unregistered land.
B. On November 1, 1993, the Plaintiff completed the registration of transfer of ownership on October 20, 1993 with respect to the land of this case, E, 225 square meters adjacent to the land of this case, F farm site 1,978 square meters, G prior798 square meters, and H forest land 61 meters (hereinafter collectively referred to as “land owned by the Plaintiff”).
C. The Plaintiff occupied the instant land as part of the Plaintiff’s land since the completion of the registration of ownership transfer.

2. Determination on the defense prior to the merits
A. On the land cadastre of the Defendant’s assertion, the land cadastre of the instant case is registered as C by its name, and there is no special circumstance such as the Defendant’s assertion that the instant land is owned by C, and thus, there is no benefit of confirmation in the instant lawsuit.
B. Determination 1) A claim for confirmation of land ownership against the State is not unregistered, and there is no registered titleholder in the land cadastre or forest land cadastre, or the identity of the registered titleholder is unknown, and there is benefit in confirmation only when the State denies the ownership of a third person who is the registered titleholder, and there are special circumstances, such as the State continuing to assert state ownership (see, e.g., Supreme Court Decision 93Da58738, Dec. 2, 1994). In addition, a ledger (a land ledger and a certified copy of the forest land cadastre) (a person who can apply for registration of ownership preservation by proving that he/she is the owner registered in his/her or his/her own or his/her predecessor’s register by means of a certified copy of the land ledger and the forest land cadastre) and
