Reasons
Punishment of the crime
【2012 Highest 1407】 The Defendant is the representative director of C in the company C, who operates and expands the coffee store specialty store.
1. On November 17, 2010, the Defendant made a false statement to the victim “G” restaurant operated by the Victim F in Gangnam-gu Seoul E 2nd floor, stating that “If the Defendant invests KRW 150,000,000,000,000,000,000,000 in a lot department store store stores around the end of January 201, the Defendant would pay 3% of shares and 21% of profits, and guarantee the profits of KRW 4,00,000 per month.”
However, the Defendant did not have any intention or ability to pay the profits, etc. to the victims by selling Dcarfs at the dcarf store store.
On November 18, 2010, the Defendant received KRW 20 million from the victim, and KRW 55 million on November 25, 201 from the victim, and acquired KRW 75 million in total through the corporate passbook of the stock company C as investment money.
2. On February 1, 2011, the Defendant made a false statement to the victim B, stating, “On February 1, 2011, the Defendant would grant the victim B a chain at the J coffee shop in front of the ticket office located in the Jail World Building. 1.50 million won as investment.”
However, in fact, the defendant did not have the intent and ability to move the chain store to the victim at the above Jina shop.
The defendant acquired the money from the victim, i.e., 30 million won from tin to the corporate passbook of the stock company C as a down payment.
3. On June 17, 2011, the Defendant made a false statement to the victim B that “The Defendant would allow the victim B to place a store with K heading and selling the k heading in the J’s building from July 1, 2011 to the J’s office.”
However, in fact, the defendant did not have the intent and ability to pay the victim the point of selling K whobs and the whobs within the wald building.
The defendant is from the victim, that is, from the victim, KRW 20 million.
