1. The defendant A shall be punished by imprisonment for one year;

Punishment of the crime

No person of "2017 Highest 1383" shall damage, destroy, alter, or forge an information and communications system, data, program, etc., or transmit or spread a program that is likely to interfere with its operation without justifiable grounds, and shall not intrude into an information and communications network without legitimate access authority or beyond permitted access authority.

1. Defendant A (one-person “I”) and Defendant B, and the name influor (one-person “J” or “K”) committed joint crimes, in collusion with the Defendants, and the name influor, were produced and developed a program that could interfere with normal operation of the game (hereinafter “mar program”) in a remote place, and then easily in selling another person’s PC screen to those who want to receive money for gambling games, and then share the same with the payment.

On September 2016, Defendant B conspiredd with the Defendants to produce the above malicious program at his own residence located in 113 dong 201, 113 dong 201, Yan-gu Seoul Metropolitan City Yan-si L, and informed the Defendant A of the method of implementation, and Defendant A sent contact with Defendant B at his own residence located in N, 302, and checked whether the above malicious program is normally downloaded and implemented at any time, and described the subject of sale of the above malicious program as shown in the attached Table 16 from Oct. 26, 2015 to Oct. 16, 2016, Defendant B entered the above malicious program in the following method: (a) Defendant B was to receive KRW 300,00 won per day from D; and (b) requested Defendant B to install the above malicious program with the PC used by D located in the 1st floor underground of Seongbuk-gu Seoul Metropolitan Government OO building; and (c) Defendant A sent the above malicious program from Oct. 27, 2016.
