A shall be punished by imprisonment with prison labor for eight months and by imprisonment with prison labor for one year.

Punishment of the crime

Defendants are members of the “Smalmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmmm.

1. On July 2014, D et al., Defendant B, including Defendant B, sought a warning that D et al., which was a staff member of a set-off line, was transferred to a competition organization, and ordered G, H, I, and J, who was a staff member of a set-off line, to “a confirmation line.”

Accordingly, around 22:00 on July 17, 2014, the above G et al. determined that E and F were transferred to the organization of the D Down, and that E and F were transferred to the organization of the Down, and that there was a case of seeking food, E, F, and K.

2. 피고인 B의 단독 범행 위 D은 2014. 7. 18. 경 위 G, H, I으로부터 피해자 E(21 세), 피해자 F(21 세) 이 크라운 파로 이적한 것이 확실하다는 취지의 이야기를 들었고, 꼴 망 파와 같은 폭력조직의 조직원이 해당 폭력조직을 탈퇴할 경우 탈퇴의식으로 해당 조직원에 대해 야구 방망이로 구타한다는( 속칭 ‘ 빳 다를 내린다’ 고 함) 원칙에 따라 피해자 E, F을 구타하기 위하여 피해자 E, F을 인천 남구 문학동에 있는 문학 경기장 입구로 불러 내었 다. 위 D은 2014. 7. 18. 23:00 경 위 문학 경기장 부근에서 피고인 및 위 L, G 등 약 15명의 꼴 망 파 조직원들과 함께 피해자 E, F을 포함한 약 10 여 명의 크라운 파 조직원들을 만나게 되었고, 그 자리에서 피해자 E, F으로부터 ‘ 꼴 망 파를 탈퇴하겠다’ 는 취지의 말을 듣자, 피고인을 비롯한 꼴 망 파 후배 조직원들에게 ‘E, F 이 꼴 망 파 조직에서 탈퇴하였으니 빳다를 내려 라( 야구 방망이로 폭행을 해 라) ’라고 지시하였다.
