A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
From August 10, 2009, the Defendant has been engaged in the accounting of the said center as a social welfare worker in the “D Center”, a facility affiliated with a social welfare foundation C located in Daegu Suwon-gu, as a social welfare foundation C.
1. On October 15, 2009, the Defendant used the Daegu Bank Account (E) under the name of the said Center, which was established for the purpose of “the principal’s charges,” for the purpose of “the victim’s social welfare foundation C, and used at will KRW 10,400 for personal purposes by withdrawing in cash the amount of KRW 10,40.
In addition, from that time until June 5, 2016, the Defendant voluntarily deposited KRW 415,84,348 in total from each of the accounts in each use, such as “tax,” “tax,” card,” etc. under the name of the above center over a total of 464 occasions, such as (i) the crime sight table, from that time until June 5, 2016, or transferred to the Defendant’s account, and consumed it for personal purposes.
Accordingly, the defendant embezzled the property of the victim while on duty.
2. On July 2013, the Defendant forged private documents: (a) voluntarily prepared the amount of money from the Defendant’s office located in the Daegu-gun F, 2013 to be exercised to prevent the commission of embezzlement, such as paragraph (1) and (2),00,000 won for the date, 130630,000 won, 8,102,349 won for “date, 511,810,000 won, 51,810 won, 9,419,939, 200,000 won, 130625, 400,000,000 won, 2000,000 won, and 81,000 won, 511,810,000 won, 9,919,939, respectively; and (b) printed out the amount of money in the name of the head of the Tong in the name of the relevant bank and attached it in the name of the passbook.
In addition, the Defendant entered the false balance as if there were actual transactions, even if the facts were not financial transactions, such as the list of crimes in attached Form 2, from March 2016 until March 2016, 33 times in total, or a financial transaction is made.
