The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. misunderstanding of facts and misunderstanding of legal principles: (a) although the blood test result received at a F Hospital on June 2, 2015 showed a high functional value; (b) there was no significant difference from the normal functional value as a result of the blood test conducted at C Hospital thereafter; (c) the Defendant, not a medical personnel, was not clearly aware of the time when he was infected with C-type infection; (d) there was no intention to indicate false facts; and (e) the Defendant solely conducted one-person demonstration in order to guarantee the patient’s right to know, and thus, the illegality should be avoided.

B. The sentence imposed by the lower court on the Defendant (three million won of a fine) is too unreasonable.

2. Determination on the grounds for appeal

A. On July 20, 2018, the summary of the facts charged 1 on the assertion of mistake of facts and misapprehension of legal principles is that the Defendant was infected with hepatitis C and was under the livering treatment for livering it by an unsanitaryly sanitary medical practice in front of C Hospital located in Ulsan-gu, Ulsan-gu, Seoul.
