The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. The court below found the Defendant guilty of all the charges of this case, although the Defendant did not deceiving the victims of the fact by deceiving the victims, and there is an error of law that affected the conclusion of the judgment by misunderstanding the facts.
B. Each sentence sentenced by the lower court (4 months of imprisonment, 8 months of imprisonment) is too unreasonable.
2. Determination
A. The Defendant’s confession at the court of first instance as to the assertion of mistake of facts alone is not likely to have the probative value or credibility of the confession, solely on the grounds that the confession at the court of appeal differs from the legal statement in the appellate court.
In determining the credibility of confessions, the credibility of confessions should be determined in consideration of whether the contents of confessions are objectively rational, what is the motive or reason for confessions, what is the reason leading up to confessions, and what is the reason why confessions go against or contradictory to confessions among other evidence than confessions (see Supreme Court Decision 2010Do2556, Apr. 29, 2010). According to records, according to the records of the court below, the defendant confessions all of the facts charged of this case on the fourth and fifth trial date with the assistance of the counsel of the State, and made a request to change the sentencing date sufficiently and sufficiently for agreement with the victims on the fifth trial date which has concluded the pleadings.
In light of the above, the defendant appears to have sufficiently recognized the meaning of the confession made in the court, and there are no circumstances that give a reasonable doubt as to the Voluntary nature, motive, and circumstance of confession, or evidence that conflict with the contents of confessions or evidence that conflict with the confessions are found. Thus, the court below's decision that the defendant guilty all of the facts charged of this case is justified, and there is no error of law of misunderstanding the facts as alleged by the defendant.
Therefore, the defendant's above assertion is without merit.
