Punishment of the crime

The defendant, who is a national of the People's Republic of China, lives as illegal aliens in the Republic of Korea and has earned a departure order from the Incheon Immigration Office of Incheon and has left China.

The Defendant sought to re-entry for the purpose of domestic job-seeking activities, but no longer remains to re-entry with his own personal information, and paid 50,000 bills (an amount equivalent to KRW 10,00,000 in the Chinese Republic of China) to the brode of the name passport, which is active in China, and obtained a false identification card indicating his name and date of birth in each “C” and “D,” and then received a passport of the People’s Republic of China based on his false identification card.

피고인은 국내 장기체류를 목적으로 2009. 3. 30.경 수원시 권선구 구운동 919-6에 있는 법무부 수원 출입국관리사무소를 방문하여, 위와 같이 발급받은 위명의 중화인민공화국 여권에 따라, 그 곳에 비치되어 있는 외국인등록신청서의 성명란에 ‘C’, 성별란의 ‘ 남’에 ‘∨’로 표시하고, 생년월일 또는 외국인등록번호란에 ‘E’, 여권번호란에 ‘F’, 여권발급일자란에 ‘2009. 2. 27.’, 여권유효기간란에 ‘2019. 2. 26.’, 신청일란에 ‘2009. 3. 30.’, 신청인 서명란에 ‘C’이라고 각 기재한 후 외국인등록 업무를 담당하는 공무원에게 제출하고, 같은 날 법무부 수원 출입국관리사무소로부터 'C'(외국인등록번호 : E) 명의로 외국인등록증을 발급받았다.
