Punishment of the crime
[criminal power] On November 14, 2014, the Defendant was sentenced to imprisonment with prison labor for fraud at the Suwon District Court for one year and six months, and the period of parole passed on April 29, 2016 during the execution of the sentence, and the parole period was expired on June 23, 2016.
【Criminal Facts】
The defendant, through the introduction of spring Dozin in 2016, collected the chairperson of the victim B, whose assets are at least 10 billion won, and constructed the apartment in the Namyang-ju.
Around June 2016, the Defendant made a false statement to the effect that “Around the early July 2017, the Defendant shall construct and sell an apartment building on the Namyang-ju in order to carry out the construction of the apartment building on the early July 2017 and sell it in lots, and the current amount of money is not well-grounded, and there is a large monthly wage for employees. On the loan of money, there is a construction site where it was not completed in the local area, and there is a construction site where it was no end in the local area, and, upon the completion of the construction of the Namyang-ju apartment, the Defendant would pay at least twice the amount invested as a dividend.”
However, there was no fact that the Defendant succeeded to the property of KRW 4 billion, and there was no investment in the construction project of the Namyang apartment, and even if the Defendant borrowed money from the victim because there was no particular asset and income with bad credit standing at the time, there was no intention or ability to repay the money to the Defendant’s personal cost of living.
As such, the Defendant, at around June 19, 2017, issued KRW 1 million to the post office account (C) in the name of the Defendant from the victim with a false statement to the victim. From that point to October 5, 2017, the Defendant received KRW 80,40,000 as a sum of 23 times as loans, such as the No. 1 through No. 23 of the crime sight table from that point of time to October 5, 2017, and 6 times, such as No. 24 to No. 29 through No. 29, the market price is 3,150,000 won.
