The prosecutor's appeal is dismissed.

1. Summary of the grounds for appeal and the sentencing (a fine of three million won is imposed);

2. The issue of the prosecutor's question is that the defendant's responsibility for the police officer is heavy, and it is right that the prosecutor's question is just.

However, in full view of the fact that the defendant recognizes the crime of this case, there is no record of criminal punishment exceeding the fine, and other factors of sentencing as prescribed in Article 51 of the Criminal Act, the sentencing of the court below is acceptable and it is not unreasonable for the prosecutor to assert it.

3. If so, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
