A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

1. Around August 11, 2015, the Defendant: (a) at the victim D’s residence located in Ansan-si, a member of Ansan-si, a member C 103; (b) at the victim’s residence, the Defendant requested the victim to take a hedging from the victim while having been in dispute with the victim due to the problem of a de facto marriage and the house; and (c) “from home” used the horses to listen to; (d) portable and wind, which are dangerous objects in the scheme, were detained against the victim.

Accordingly, the defendant abused the victim by using dangerous things.

2. 공무집행방해, 상해 피고인은 제1항과 같은 일시 장소에서 ‘여자가 울면서 다 부수고 동거하는 남자가 밖에 나와 있다’는 112신고를 받고 출동한 안산단원경찰서 E파출소 소속 순경인 피해자 F에게 제1항과 같은 이유로 현행범인 체포되어 파출소로 연행되는 과정에서 피해자가 피고인을 순찰차량에 태우려고 하자 피해자에게 “씨팔, 지랄하고 있네, 나랑 맞짱 뜨자, 니가 나 이기면 순순히 간다”고 소리치며 발로 피해자의 이마 부위를 1회 걷어 차 피해자에게 약 2주간의 치료가 필요한 코의 표재성 손상을 가하였다.

As a result, the defendant interfered with legitimate execution of duties by police officers on public peace and maintenance of order, and at the same time injured the victim.

3. The Defendant damaged public goods, at the time and place as referred to in paragraph (1), was arrested in flagrant offender on the grounds as referred to in paragraph (1), and was carried out by the police box with G rocketing patrol vehicle of the Ansan Police Station, the Defendant destroyed the vehicle door to have KRW 83,520 of the repair cost, such as walking the back door of the police box may even take off, by walking the front door of the police box.

Accordingly, the Defendant damaged the goods used by public offices.
