피고인은 2015. 2. 7. 18:30 경부터 19:30 경까지 남양주시 F 건물 402호 피고인의 집에서 친구인 G과 함께 술을 마셨는데 당시 피해자는 방안에서 신음소리를 내며 앓을 정도로 건강이 좋지 않았고, 같은 날 22:00 경에는 화장실에서 넘어지면서 벽에 머리를 부딪쳐 흑색 변을 보고 바닥에 누워 움직이지 못하는 채로 말도 못하면서 눈만 깜박이고 고개만 끄덕이는 위중한 상태에 이 르 렀 다. 따라서 피고 인은 위와 같이 위중한 상태에 빠진 피해자를 119 신고 등을 통해 즉시 병원으로 후송하여 치료를 받게 하여야 함에도 불구하고, 쓰러져 있는 피해자의 팔을 잡아끌어 거실 바닥으로 옮겨 놓고 이 불만을 덮은 채 그대로 방치하였을 뿐 아니라, 2015. 2. 8. 저녁 무렵에는 거실 바닥에 눕혀 둔 피해 자가 의식마저 잃었으므로 그 즉시 피해자를 병원으로 후송하는 조치를 취해야 함에도 계속해서 피해자를 방치하다가 2015. 2. 9. 15:00 경 G의 처 H가 찾아와 피해자를 병원에 데려갈 것을 재촉하는데 다가 피해자의 입에서 거품이 흘러나오자, 그제서야 같은 날 15:16 경 119에 신고 하여 피해자를 병원으로 후송하였다.
