A Imprisonment with prison labor for one year and for three months, respectively.
Reasons
Punishment of the crime
1. The co-principal defendant A is the representative of F (ju) who carries on the cargo transport business, the representative of (ju)G who carries on the cargo transport business, and the victim H is the owner of an I commercial cargo vehicle in the name of F (ju).
The Defendants, with respect to the opportunity for Defendant A to sell the number plate of the cargo vehicle for the above business purpose to Defendant B, and with respect to the number plate of the cargo vehicle for business use that is not incidental to the owner of the land, the Defendants conspired to sell and purchase the vehicle number plate to the victim, stating that even if the number plate of the vehicle is transferred to the owner of the land, the victim would continue to guarantee the status of the owner of the land, thereby allowing the victim to terminate the agreement with the owner of the vehicle number plate, and selling and buying the vehicle number plate.
Defendant
A around July 2015, around the end of 2015, the victim called “the vehicle number plate was made to be exceeded in the State.” At that time, Defendant B, one’s own employee, ordered the victim to receive the vehicle number plate from the F through the J, which is the victim’s order to keep the status of the branch owner, and the victim would be able to operate the said vehicle while maintaining the status of the branch owner, if the victim cooperates in the termination of the branch entry contract with F (State) with the said vehicle.
However, the Defendants did not have any intent or ability to allow the Plaintiff to operate the said vehicle in the state of maintaining the status of the land owner even if the victim terminated the contract, as seen above, while the Defendants thought to sell and purchase the number plate of the cargo for business use in the state of absence of the land owner.
Nevertheless, the Defendants deceiving the victim as above and belong thereto by the J around August 12, 2015, and the written consent to dismiss the victim in the name of the victim.
