1. Defendant shall be punished by a fine of 5,000,000 won;

2. If the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

A person who intends to convert a mountainous district shall obtain permission from the Administrator of the Korea Forest Service, etc. according to classification of mountainous districts specified by Presidential Decree, size, etc.

Nevertheless, on April 5, 2015, the Defendant, without obtaining permission for conversion of mountainous district, removed standing timber and made a conversion of mountainous district by changing the form and quality of mountainous district by using quickers, etc. for the purpose of creating farmland on the 4,907 square meters of Guncheon-si Forest and C Forest, which is mountainous district, and 4,907 square meters of farmland.

The reason for sentencing under Article 334(1) of the Criminal Procedure Act of the provisional payment order applied for approval of the design for restoration of the damaged mountainous district to the Chuncheon Mayor on May 15, 2015, and the Chuncheon Mayor, on May 17, 2015, ordered the Defendant to restore the damaged mountainous district to its original state as designed by June 15, 2015 and order the Defendant to restore the trees to its original state until November 30, 2015, and to restore the trees to its original state until November 30, 2015, shall determine the punishment as ordered by the order, taking into account favorable circumstances, such as the fact that the Defendant is the first offender who has no previous criminal record.
