A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On June 12, 2008, the Defendant was sentenced to a suspended sentence of ten months for a violation of the Punishment of Violences, etc. Act (joint injury) in the branch court of Suwon District Court on October 12, 2008, and the judgment became final and conclusive on the 20th day of the same month. On December 10, 2009, the Defendant was sentenced to imprisonment with prison labor for one year for the crime of forging securities, etc. in the branch court of Suwon District Court on December 10, 2009, and six months for perjury, etc. at the Suwon District Court on July 8, 2010, each of the above decisions became final and conclusive on October 19, 201, and on June 2, 2011, two years for a suspended sentence of imprisonment with prison labor for one year at the Suwon District Court for fraud and the judgment became final and conclusive on
On February 8, 2006, the Defendant, while working as a representative director, entered into a contract for construction works of G Borrowing (hereinafter “this case”) with the actual owner E on February 8, 2006, but the said contract was rescinded on July 6, 2007 due to the payment of the price, etc., and thereafter, the Defendant entered into a trade promise with E to purchase the whole loan by paying the purchase price of KRW 3 billion by November 25, 2007, but did not pay the purchase price.
Nevertheless, the Defendant prepared a sales contract to sell this loan Nos. 101 and 201 to him, as if he had ownership of this loan, with respect to the authorization and permission of this loan, which is the owner of this loan, with the intention to borrow money as security.
1. Forgery of private documents and the display of private documents;
A.
