However, T does not inform the location of the office, the status of operation, the transfer of the investment funds delivered to the fund raisers, the actual user, the source of dividends delivered to the investors, etc., and it does not have FDM (FDM, international exchange) license necessary for FX M trading, and Korea does not have a branch office.

The Defendants conspired to acquire and distribute part of the funds by means of using them as allowances for supporting the recommendation of domestic investors and dividends of senior investors, etc. instead of transferring the funds to a foreign country, if they make an investment in the Republic of Korea-oriented investors delegated by the T head office in a foreign country against many and unspecified persons, by explaining as if they could be guaranteed principal and high-profit profits.

Therefore, the Defendants, as a specialized securities company that has a branch office in Singapore, is authorized by FDM for many and unspecified persons, and the Lyennish Holdings Supup Group Co., Ltd. is a private affiliated company in Thailand, and T creates high profits by trading FX M in investment with members.
