Defendant shall be punished by a fine of KRW 10,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[2015고단65] 피고인은 2011. 3.경부터 피해자 C와 동거 생활을 한 사이로, 피고인은 금융권 채무 및 사채를 갚거나 생활비에 충당할 목적으로 남편과 이혼소송 진행 중이거나 실제 이혼 소송을 하면 위자료를 2억 원 가량 받을 수 없었고, 펀드에 투자한 금액도 없었으며, 진주시 주약동 소재 성우팰리스를 보유하거나 음악학원 2개를 운영한 사실이 없음에도 불구하고 피해자 C에게 거짓말을 하여 피해자 C, 피해자 C의 아버지와 동거 관계에 있던 피해자 D으로부터 돈을 편취하기로 마음먹었다.

1. Around November 14, 2011, the Defendant against the victim C made a false statement to the victim C, stating that “A victim C operates two private teaching institutes at Changwon, which would interfere with the husband’s operation of private teaching institutes and the Plaintiff’s operation of private teaching institutes, which would interfere with the Plaintiff’s operation of private teaching institutes and leave the Plaintiff with a reproduction machine and computer. It would be 15 million won if repayment is made within several days.”

However, the fact did not have been operated in the Changwon, and even if it borrowed money in excess of the obligation at the time, there was no intention or ability to pay it.

As such, the Defendant, by deceiving the victim C, received KRW 15 million from the victim C to the Defendant’s account or the Defendant’s order at that time, and, from that time until June 18, 2012, by making a false statement, as shown in the attached Table 1 List, and by defrauding the total amount of KRW 28 million over eight times in the same manner.

2. The Defendant against the victim D, around June 28, 2012, found with the above C at the victim D’s house located in the Masung-gun F, G, and caused C to “A to receive insurance proceeds at the maturity of KRW 600 to KRW 80 million upon payment of the insurance premium to the hospital at the rate of KRW 8 million from the hospital suffering from cancer. The insurance proceeds will be repaid at the time of the occurrence of the insurance proceeds within two weeks.
