누구든지 공포심이나 불안감을 유발하는 부호ㆍ문언ㆍ음향ㆍ화상 또는 영상을 반복적으로 상대방에게 도달하게 하여서는 아니 됨에도, 피고인은 2014. 6. 1. 15:58경 서울 서대문구 B, 102호에 있는 피고인의 집에서 피고인이 사용하는 휴대전화 카카오톡 어플을 이용하여 피해자 C가 사용하는 휴대폰으로 ‘ㅋㅋㅋㅋ아놔ㅋㅋ미친 돼지 육덕년이’ 라는 내용의 문자를 전송한 것을 비롯하여 별지 범죄일람표 기재와 같이 20회에 걸쳐 문자를 전송하고, 3회에 걸쳐 화상을 전송하여 공포심이나 불안감을 유발하는 문언, 화상을 반복적으로 피해자에게 도달하게 하였다.
