A defendant shall be punished by imprisonment for a term of one year and four months.
Reasons
Punishment of the crime
Although the Defendant had three children with her husband, he misrepresented the unmarried women by transmitting another’s photograph to the victims who became aware of through hosting at the Internet Africa site (www.afrec.com). The Defendant was willing to obtain money from the victims, while carrying out the cyber most teaching system premised on marriage.
1. Around April 10, 2014, the Defendant made a false statement to the effect that “A (the Defendant) was able to exercise the right to demand the deposit of a dam, and sent the value of the right to demand the deposit of a dam,” by phoneing to the victim D who became aware of through the Internet site as above at the Defendant’s house at the Tong-si, Tong-si.”
However, in fact, the Defendant was thought to purchase cyber money (i.e., one’s own name) on the above Internet site with the money received from the victim, and there was no intention to pay the value of the right to demand the payment from the beginning or to teach with the victim on the premise of marriage with the victim.
As above, the Defendant, by deceiving the victim as above, received KRW 1,00,000 from the victim under the name of the value of the exercise of the contract on the same day, and received KRW 207,717,000 in total over 36 times from that time to June 15, 2014, as shown in the attached list of crimes (1).
2. Around June 24, 2014, the Defendant sent text messages to the victim F, who became aware of the Internet site at the above Defendant’s home, to the effect that “If the Defendant loaned the security deposit to the lessee of a building owned in Seoul Gangnam-gu through the mobile phone Kakao Stockholm, the Defendant would make reimbursement after two weeks thereafter.”
However, in fact, the defendant had no intention to teach with the victim on the premise of marriage with the victim, and had been willing to purchase cyber money from the victim from the beginning, and there was no intention or ability to repay the borrowed money as agreed without any property or source of revenue.
