Reasons
Punishment of the crime
1. Defendant A and B joint crimes (special larceny) Defendant A shall have worked for a long time as the head of the victim M&M, and Defendant B shall have a tonnage of scrap metal used as a raw material for the production of the product in the factory, and deduct them from each other, while serving for a long time as the head of the P&M, Defendant B;
Using the fact that it is not easy to confirm even, the employees of the factory disposed of the scrap metal in the factory on the water at night at night, which is located in the factory, and conspired to divide the profits therefrom.
On November 3, 2016, between 22:00 to 23:00, the Defendants: (a) completed night work in the M&A factory located in Seo-gu Incheon, Seo-gu, Incheon; (b) and (c) obstructed surveillance by leaving the factory, and (d) contacted Defendant B with the Defendant to keep the CCTV camera installed in the after door of the factory from video recording; (b) Defendant A, in contact with the Defendant, was parked in the front of the factory with the 11,76 kilograms market price, 4,03,840 won, which was kept in front of the factory; and (c) Defendant B stolen the sum of the victim’s 11,66 kilograms market price from around 60 to 966:6 to 306; and (d) the total market price of the victim from around 2008 to 96:6:65; and (d) the victim’s total market price of the 36:605 kilograms from around 2008 to 96:6:6606.7.46.6.65.7.6.44.
2. The sole crime of Defendant C, D, or E (the acquisition of stolen objects);
A. On January 6, 2008, the Defendant purchased 3,140 g of scrap metal 3,140 g, which was stolen by the Defendant in Seo-gu Incheon, as above, from 196 times in total, to 4 October 2012, the Defendant purchased 2,09,298 g of scrap metal 2,09,298 g from around 196 to 884,659,200 won in total, as shown in Appendix II, with knowledge that it was stolen by the Defendant and the Defendant acquired the stolen goods.
