A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for ten months.

However, for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Subsidy Management Act;

A. Defendant A related to the purchase of materials is the representative director of Ori-gu C&D Co., Ltd., Ocheon-si, and Defendant B is the standing director and the auditor of the above D.

No person shall receive subsidies by a false application or by other unlawful means.

Nevertheless, from March 2, 2015 to February 28, 2017, the Defendants: (a) purchased parts irrelevant to the above development task under the name of “E development” through an agreement with the Small and Medium Enterprise Information Promotion Agency; and (b) applied for false purchase of parts to be used for the said development task; and (c) conspired to receive national subsidies.

Accordingly, even if the Defendants, around February 17, 2016, connected to the research expense payment system at the aforementioned D office and purchased materials necessary for STS irrelevant to the aforementioned research task from F on or around February 2, 2016, the Defendants submitted a false statement of transaction prepared as if they purchased necessary equipment (other than 11 items) for the research task (project number G) and received subsidies equivalent to KRW 1,520,000 from the date of the submission of the false statement of transaction entered in the research expense payment system as shown in the attached Table 1 from March 28, 2016 to March 28, 2016, and received subsidies of KRW 21,346,000 in total from the date of the submission of the false statement of transaction expense stated in the research expense payment system as stated in the attached Table 1, the Defendants submitted the false statement of transaction expense number 20,000,0000 from the above DD office around March 30, 2016.
