Reasons
Punishment of the crime
[2012 Highest 11030] Defendant A is a person who works as a brokerage assistant at the H Licensed Real Estate Agent Office located in Nam-gu Incheon Metropolitan City G.
On November 2010, the Defendants purchased LBD 401 (hereinafter “instant loan”) in the name of Defendant C from the Nam-gu Incheon Agricultural Cooperative under the name of the Defendant, and concluded a lease contract with the Labor Union Co., Ltd., and concluded a lease contract, and subsequently disposed of the said loan with a voluntary auction through outstanding loans. Defendant B and C prepared necessary documents, delivered them to Defendant A, and delivered them to receive part of the proceeds therefrom.
1. Violation of the Act on the Registration of Real Estate under Actual Titleholder’s Name;
A. On November 201, 2010, Defendant A and B agreed to purchase the instant loan in the name of Defendant A, but agreed to purchase it in the name of Defendant A. On December 12, 201, Defendant A, at the same place as the first policeman, issued to N a copy of the resident registration certificate, personal seal impression, etc. under the name of the seller M and buyer, and Defendant B, at the same time, issued to N a resident registration certificate, personal seal impression, etc. under the name of the seller, and registered a real right to the instant loan in the name of a title trustee pursuant to a title trust agreement.
B. On November 2010, Defendant C entered into a title trust agreement with A and B in the above certified judicial scrivener office, and registered the real right to real estate under the name of the title trustee, pursuant to the title trust agreement, by allowing the registration of ownership transfer with respect to the loan of this case in the name of the Defendant around December 2 of the same year.
