1. The defendant A shall be punished by imprisonment with prison labor for two years and by imprisonment for one year; and

2.Provided, That this judgment has become final and conclusive.

Punishment of the crime

Defendant

A as a doctor, is the president of the H Hospital affiliated with the G Medical Foundation, and the defendant B is the assistant nurse of the operation office of the above H Hospital.

1. 2. The sole criminal conduct of Defendant A;

Nevertheless, around January 2010, Defendant A applied for medical care benefits in relation to the above surgery to J by the National Health Insurance Corporation located in Seocheon-gu, Busan, Busan, for the payment of medical care benefits, along with relevant documents as if he/she had performed the operation.
