1. Of the principal lawsuit of this case, the part demanding KRW 126,000 shall be dismissed.
2. The Defendant (Counterclaim Plaintiff) is the Plaintiff.
Reasons
A. The instant contract was concluded on the consignment service for the production of design (hereinafter “instant contract”).
In the above contract, the Defendant: (a) made the website of “D” operated by the Plaintiff on November 30, 2015; (b) paid KRW 1,50,000 to the Defendant in return; and (c) paid KRW 750,000 on the date of the contract and KRW 750,000 on the remaining 750,000 on the date of the contract; and (d) paid each of the “service completion date” within 10 business days after delivery.
The main contents of the above contract are as follows:
Article 2 (Work Schedule, Items) The schedule and work categories of this Agreement shall be as follows:
(1) Work schedule: November 6, 2015 to November 30, 2015.
Contract Affairs Statement (Attached 1)
1. Design and manufacture by Category D within the scope of duties to be provided;
2. Details of the business affairs related to the D website design and the D website blishing;
3. The “applicant” may request changes in the type and number of copies as set forth above during the contract period PTPP Rate D domain name/S-rating D website*, and the “provider” should be accepted unless there are special reasons.
Article 3 (Contents and Scope of Services) (1) “B” (referring to the defendant; hereinafter the same shall apply) shall carry out and complete the development work of “A” (referring to the plaintiff; hereinafter the same shall apply) in “B” in good faith.
(2) The term "completion" in the contract means the final approval of the production submitted by "B" to "A".
Article 4 (Business Method) (1) "B" shall obtain approval from "A" through pule ether or marina, and shall be completed and approved in accordance with the pointed out matters or the inseminator's port.
(2) "A" shall provide efficient information on existing materials or materials needed for work in-house and shall provide all kinds of convenience necessary for work.
