A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 18, 2018, at around 07:50, the Defendant committed an indecent act for about two minutes, after the victim E (V, 27 years of age) in the electric train in the subway line 2 subway stations located in Yeongdeungpo-gu Seoul Metropolitan Government, while operating the D Station between D Station 2 and D Station.

Accordingly, the defendant committed an indecent act on people in a concentrated place such as means of public transportation.

However, in light of the following circumstances known by evidence duly adopted and investigated by this court, it can be sufficiently recognized that the defendant committed the crime in the judgment.

When the victim is forced to commit an indecent act, the victim directly confirmed the offender's appearance.

피해자는 고소장 제출 당시 가해자의 인상착의를 ‘파마머리 또는 곱슬머리, 턱과 입은 돌출형이고 눈은 움푹 들어간 형태의 각진 얼굴, 까무잡잡한 피부색, 밝은 색상의 재킷 안에 다소 화려한 무늬가 있는 검정색과 회색이 섞인 티셔츠 착용, 나이는 40대 초ㆍ중반, 마른 체형, 키는 173 ~ 176cm 정도’로 설명하였는데, 이는 피고인의 판시 범행 당시의 인상착의와 거의 일치하고, 특히 위 얼굴 모습의 설명은 이 법원의 공판기일에서 확인되는 피고인의 생김새와도 일치한다.
