A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2017 Highest 5121]

1. On October 27, 2017, the Defendant: (a) went in front of a restaurant operated by the victim D in Daejeon-dong, Daejeon-gu, Daejeon-gu, at around KRW 24:00; (b) went into front of the restaurant; and (c) cut off cash 15,000, which was owned by the victim who was in the Kitter’s depository.

2. On October 31, 2017, the Defendant: (a) intruded into a restaurant at around 24:00 at the place specified in paragraph 1; (b) through a opened window; and (c) in cash owned by the victim who was in the Kacter’s depository located in that place; and (d) the market price equivalent to KRW 1,000 at the rate of KRW 1,000 at the air condition kept in the air conditioners.

[2018 Highest 1032] On February 6, 2018, the Defendant: (a) opened and intruded into “H restaurant” operated by the victim G in Daejeon-dong, Daejeon-gu, Daejeon-gu; (b) opened and intruded into the unrecepted main window; and (c) included brub in a brub, which was located in the inside of the brub; (d) brought a brub from the kitchen; and (e) cut off food influent market value, which is the victim’s possession, by inserting a brub into a brub, and inserting a brub into a brub.

As a result, the Defendant intruded on a structure managed by the victim at night, and stolen the property owned by the victim, from that time to February 2018, the Defendant committed crimes of larceny and larceny at night, as shown in the list of crimes in the annexed crimes, from that time to that time, 7 times in total.

[2018 Godan 1156] On October 26, 2017, the Defendant came to the front of the restaurant operated by the victim J in Daejeon-dong, Daejeon-gu, Daejeon-gu, and went to the front of the restaurant, with the cash owned by the victim, who was in his/her possession, by entering the restaurant through the open window and went to the restaurant with 150,000 won.

Accordingly, the defendant invadedd a structure at night and stolen the victim's property.

[2018 Highest 1266] On October 20, 2017, the Defendant was engaged in the LPC room located in Daejeon-gu Daejeon-gu, Daejeon-gu, where the victim’s name was not the victim’s name. Despite having no intent or ability to pay the use fee, the Defendant would have to pay the said PC M, an employee of the said PC.
