1. Each real estate entered into on December 12, 2017 between the Defendant and D as indicated in the separate sheet.
Reasons
1. Basic facts
A. The Plaintiff’s claim 1) On May 4, 2017, the Plaintiff issued D and E (hereinafter “D, etc.”) Nos. 2017Kadan2222 with the Changwon District Court 2017 Dadan2222.
(2) On November 29, 2017, the appellate court filed a lawsuit against Eul (with respect to D, based on the confirmation document written on November 18, 2014 between the Plaintiff and D) seeking payment of the agreed amount. On November 29, 2017, the said appellate court rendered a judgment that “D, etc. jointly pay to the Plaintiff KRW 60,00,000,000, and damages for delay therefor,” and “D, etc. jointly pay to the Plaintiff.” (2) The appellate court appealed with Changwon District Court Decision 2017Na61000 on January 11, 2019, but the appellate court rendered a judgment that determined that “D, etc. jointly pay to the Plaintiff KRW 60,00,000 as well as D’s 5% per annum from the following day to November 29, 2017; 15% per annum from the day following the date of full payment; and 25% per annum from the date of full payment.”
B. D’s act of disposing of D’s property concluded a mortgage agreement with the Defendant on December 12, 2017 on each of the real estate indicated in the separate sheet attached thereto (hereinafter “instant mortgage agreement”) as to each of the real estate owned by the Defendant, and completed the registration of establishment of a neighboring mortgage in the name of the Defendant (hereinafter “the registration of establishment of a mortgage”) under the title of the original district court No. 52945, Dec. 13, 2017, which was received on December 13, 2017 (250,000,000).
C. At the time of concluding the instant mortgage contract (as December 12, 2017), the real estate status 1) active property Nos. 11,410,00 as indicated in the attached Table Nos. 11, 410,000 as of March 12, 2018, the second floor detached house 248,134,1204, among the third real estate listed in the attached Table No. 3 as indicated in the attached Table No. 21,930,503 as of March 12, 2018, the real estate No. 45,57,000, as indicated in the attached Table No. 3 as of March 12, 2018.
