1. 피고인 A 피고인은 2016. 12. 28. 08:50 경 인천 서구 F에 있는 G 교회 사무실에서 담임 목사의 출교 처분 문제로 시비하다가 목사를 지지하는 피해자 B가 출입문 자물쇠를 교체하려 한다는 이유로 피해자의 어깨를 손으로 밀치며 팔로 목을 감 싸 넘어뜨려 피해자에게 약 14일 간의 치료가 필요한 열린 두개 내 상처가 없는 진탕 등의 상해를 가하였다 피고인의 방어권 행사에 지장이 없는 범위에서 공소사실을 정정하였다( 피고인이 피해자를 수회 발로 걷어찼다는 부분을 제외하였다). . 2. 피고인 B 피고인은 제 1 항의 일시 장소에서 위와 같은 이유로 시비하다가 피해자 A의 어깨를 손으로 강하게 1 회 밀쳐 폭행하였다.

A. The Defendant and his defense counsel’s argument that the victim B is a support person of H who is attending the G church, and therefore, they cannot enter the above church.

However, at the time of the instant crime, the victim B committed the instant crime to prevent the Defendant from infringing upon the church office office without permission, and the Defendant’s act constitutes a justifiable act that does not go against the social norms.

B. At the time of the instant crime, the use of violence by the victim regardless of whether H was in the position of pastors of the instant church, and whether the victimized person was authorized to enter the said church is not appropriate.
