1. The Defendants shall be punished by a fine of KRW 3,750,000.
2. The Defendants did not pay the above fines.
Reasons
Punishment of the crime
Defendants are non-registered wholesalers (one-person referred to as "multi-registered wholesalers") who purchase tobacco manufactured in their respective KT&G and supply such tobacco to cafeterias, etc. which are not designated as retailers.
A person who intends to operate a tobacco retail business shall be designated by the head of a Si/Gun/Gu having jurisdiction over the location of the place of business.
1. The Defendant: (a) sold a large amount of tobacco to consumers, such as workers, etc. of the cafeteria located in Q Q from January 2012 to July 2014; (b) in order to assist Q from being designated as a tobacco retailer, the Defendant committed the crime of selling the 116 unregistered retailers, including those indicated in Table A, in the same manner, in order to assist the said unregistered retailers in selling a large amount of tobacco from January 2012 to July 2014; (c) in order to assist Q from being aware of the fact that Q was not designated as a tobacco retailer, the Defendant: (a) sold the 116 unregistered retailers in the same manner; and (d) sold tobacco to Q from January 2012 to July 2014 in the same manner; and (e) sold the 2,579,349 (Ado 5,803,535,250 won).
Accordingly, the defendant 116 non-designated retailers, such as Q, assisted the act of selling tobacco to consumers without being designated as retailers.
2. The Defendant sold a large amount of tobacco to consumers, including workers, etc. of the said Corporation, at the W cafeteria located in the Silsi Construction Corporation V from January 2012 to July 2014 by U. U.S. In order to assist U in a sale of tobacco retailers, he/she sold a string of the said period of time by using a string vehicle (X) vehicle owned by the Defendant, and selling a monthly 25 cigarette to U for the said period of time with knowledge of the fact that U was not designated as a tobacco retailer. In addition, as described in the List of Crimes List, 90 unregistered retailers from January 2012 to July 2014 are all workers, etc. of the said Corporation.
