Punishment of the crime
Defendant
A Co., Ltd. is a business owner performing the “E New Construction Corporation” located in Ansan-si. Defendant B, as a director of the above A Co., Ltd., a person who is in charge of overall affairs concerning safety and health of all workers, including the victim F working at the above construction site, as a supervisor of the above construction site. Defendant C is a business owner who actually employs the victim as the actual business owner of G, and leases a pumps from the above A Co., Ltd. to concrete another construction site.
1. Violation of the Industrial Safety and Health Act in relation to the death of victims, and occupational and dental death;
(a) A business owner engaged in the business conducted in the same place as in violation of the Industrial Safety and Health Act, occupational matters, and death or injury to Defendant B, for which part of the business is divided into contracts, shall take measures to prevent industrial accidents that may arise when his/her employees and his/her employees work at the same place.
