In full view of the facts without dispute, Gap 1, 2, and Eul 1's respective statements and the overall purport of the arguments, the plaintiff running the tegrative construction business may be acknowledged as the fact that on August 31, 2013, the plaintiff paid the plaintiff a sum of KRW 15 million including KRW 5 million around October 2013, and KRW 15 million to the plaintiff with the defendant operating the tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative tegrative lag.
The plaintiff alleged by the parties that the construction price of this case is 62 million won. Among them, 15 million won is 47 million won for the payment of the construction price to be paid from the defendant with the above D Sports Head Office, and 15 million won for the payment of the construction price. Thus, the remaining 32 million won should be paid (=62 million won for the head office - 15 million won - Defendant 15 million won for the head office).
In regard to this, the Defendant asserts that the construction cost of this case is KRW 47 million, and among them, KRW 15 million was paid by the said D Sports Head Office, and that the Defendant paid KRW 15 million, the construction cost to be paid is KRW 17 million (= KRW 47 million - KRW 15 million - Defendant’s head office subsidies - KRW 15 million).
Judgment
According to the statement in Eul 1, the construction contract entered into between the plaintiff and the defendant is 47 million won for the total construction cost under Article 2, and the fact that "the head office subsidy of 15 million won" is stated next to that, there is room to view that under the text of the above construction contract, the total construction cost is 47 million won for the construction cost and the 15 million won among them is 15 million won for the head office subsidy.
However, comprehensively taking account of the respective descriptions and the overall purport of the pleadings, the Plaintiff is a company that operates the D sports head office on October 21, 2013.
