A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The Defendant was a person who operated a mutual loan brokerage company with the name of “C” on the fourth floor of the Seoul Special Metropolitan City Nowon-gu building B.

1. Around January 26, 2018, the Defendant made a false statement to the effect that “When sending money to the victim D, the Defendant would repay the loan obligation of E guaranteed by the victim to the previous victim with the money, and convert the loan to a low interest rate by raising credit rating of E, and return money to the victim’s joint and several sureties.”

However, even if the defendant received money from the victim, he was trying to use it for personal debt repayment and purchase bit Coin, and he did not have the intent or ability to return the money by repaying the loan debt with the money sent by the victim and repaying it at low interest.

On February 1, 2018, the Defendant, by deceiving the victim as above, received KRW 40,000 from the victim’s account in the name of the Defendant to the F Bank (G) account in the name of the Defendant.

2. On March 17, 2018, the Defendant against the victim H: (a) sent the victim H a credit rating of KRW 50 million by telephone to the said office; (b) made the Defendant obtain a loan from a commercial bank; and (c) returned the said money within seven to ten (7) days.

However, even if the Defendant received money from the victim, the Defendant merely attempted to use it for personal debt repayment and the purchase of bitcoin, and the victim did not have any intent or ability to have the victim get a loan from a commercial bank or return the said money. The Defendant, by deceiving the victim as above, was remitted KRW 40,000,000 from the victim to the F bank account under the name of the Defendant (G) on March 17, 2018, and KRW 10,000,000 on March 20, 2018, respectively.
