Reasons
Punishment of the crime
On September 17, 2015, the Defendant prepared a false complaint at the D Office of Limited Company D, Inc., Inc., located in Busan-si, Seoul-si, for the purpose of having E and F receive criminal punishment, and submitted it to the public service center of the former Jinjin-gu, Seoul-gu, 299 on the same day, and made a supplementary statement at the above police station on the same day.
The summary of the statement in the complaint and the statement in the supplement of the complaint are as follows: (a) in collusion with Defendant Soviet (E and F) on April 20, 2015, the purchase price of the land of the aggregate of 755 square meters (hereinafter referred to as “the land of this case”) 755 square meters, including Jeonju-si G, Jeonju-si (A), was KRW 14 million; (b) the down payment of KRW 15 million on the date of the contract; and (c) the remainder amount of KRW 99,000,000,000,000 on May 19, 2015, the complainant rescinded this contract because it did not pay any balance after entering into a sales contract with the intention to pay it on May 19, 2015; and (d) on June 30, 2015, the purchase price of the land of this case increases, and KRW 279,500,000,000,000.

While concluding a new contract to pay in 23.2, the Defendants merely paid KRW 100 million out of the purchase price, deeming that they did not pay KRW 115.9 million in the remainder of the purchase price, and concluded a contract with the intention to acquire money from the beginning and transferred the ownership of real estate, and thus, they were punished as fraud and punished as criminal fraud.
However, on April 20, 2015, the Defendant sold this parcel of land to KRW 114 million between E, but the down payment of KRW 15 million was concluded on the date of the contract and KRW 90 million on May 19, 2015, and E paid the down payment of KRW 15 million according to the contract, and at the same time, paid KRW 15 million on August 26, 2015 and paid KRW 100 million on the same day.
