A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
On November 6, 2014, the Defendant was sentenced to six months of imprisonment for fraud at the Seoul Southern District Court, and the judgment became final and conclusive on March 19, 2015.
1. The defendant, C, D, E, and F violated the Punishment of Violences, etc. Act (a collective injury with a deadly weapon, etc.), who is a criminal organization, and the victim G (tentative name) who is a non-astronomical wave action team, did not report to the steering staff, but did not report to the police officers belonging to the Do Provincial Police Agency, a metropolitan investigative group, to the police investigation. The victim was suspected of having been in cooperation with the police investigation.
Therefore, the Defendant, around 21:00 on May 31, 2013, while drinking alcohol together with the above C, D, E, and F at the Iam room located in Seocheon-gu, Seocheon-gu, Busan, the Defendant continued to have telephone conversations with the victim, and the Defendant, other than the Defendant, became aware of the grounds for the dispute between the Defendant and the victim.
Then, the Defendant had the victim sing in the face of the instant singing, and the victim, including the Defendant, continued to provide that “A had not produced any son,” but did not recognize the victim’s face, C, D, E, and F, due to the victim’s failure to cooperate with the police investigation, C took the victim’s face at home and took the victim’s face from the floor, and E, C, C, and D suffered injury to the victim, such as non-fringing the victim for about four weeks of medical treatment, when E and F took the victim from both sides.
Accordingly, in collusion with C, D, E, and F, the Defendant inflicted an injury on the victim by force of organization or multiple groups.
2. Violation of the Punishment of Violences, etc. Act (joint assault) and D shall be a person who is the cause of an innate-gu behavior, and shall be an innate-gu, Nowon-gu, Seoul Special Metropolitan City, around 18:00 on July 15, 2013.
