A defendant shall be punished by imprisonment for not more than ten months.

Of the facts charged of this case, the prosecution against assault is dismissed.

Punishment of the crime

On April 20, 2018, the Defendant was sentenced to imprisonment with prison labor for the obstruction of performance of official duties by the Seoul Central District Court on August 20, 201, and is currently under suspension of execution.

『2018고단6373』 피고인은 2018. 5. 20. 06:30경 서울 중구 B에 있는 C의 집에서, 피해자 D(43세)이 피고인의 애인인 위 C에게 심한 내용의 문자메시지를 보냈다는 이유로 화가 나, 손으로 피해자의 얼굴을 2회 때리고, 발로 피해자의 얼굴 부위를 3회 걷어찼다.

1. 업무방해 피고인은 2019. 2. 11. 00:05경부터 같은 날 00:25경까지 사이에 서울 중구 E 1층에 있는 피해자 F가 경영하는 ‘G’ 식당에서, 술에 취한 상태로 위 식당에서 식사를 하고 있던 손님들에게 ‘뚱뚱하고 못생긴 새끼들’이라고 말하고 함께 사진을 찍자고 하는 등 시비를 걸고 반말과 욕설을 하면서 소리를 지르며 소란을 피우는 등의 위력으로 피해자의 식당영업 업무를 방해하였다.

2. Damage to public goods;

A. On February 11, 2019, at around 00:30, the Defendant: (a) arrested a flagrant offender from police officers belonging to the H District Police Officers of Seoul Central Police Officers, who received a report at the above location 112; and (b) took a bath while on board the back seat of the police police vehicle No. 52; and (c) was walking the safety partitions installed between the front seat of the police vehicle and the rear seat on a hand, thereby damaging the above safety partitions to have approximately KRW 8.20,00 of the repair cost.

Accordingly, the defendant damaged the safety partitions of police vehicles, which are goods used by police stations, which are public offices, and has harmed their utility.

B. The Defendant, around 02:30 on February 11, 2019, arrested flagrant offenders at the Seoul Central Police Station’s Criminal Police Station and the watchkeeping room located in Jung-gu Seoul Central Police Station and waiting for the left part of arms with the locking.
