Defendant C is based on the building permit attached Form 1 on the ground of termination of title trust as of November 10, 2015 to Defendant B.
Reasons
1. Basic facts
A. In March 2012, the Plaintiff sold each land to Defendant B and E, 3,736 square meters, G 1,702 square meters, G 1,702 square meters, and H and I, respectively.
B. In April 2012, Defendant B and E entered into a contract with J to exchange the same 1,983 square meters of the said F and G land and the same 2,101 square meters of the said land (hereinafter “K land before division”) and the same 1,122 square meters of the L cemetery (hereinafter “B before division”). Defendant B and E entered into a contract with Defendant B and E to purchase the same 114,000 square meters per square meters of the relevant land before division.
C. On August 14, 2012, M obtained a building permit indicated in attached Form 1 “instant building permit marking” with respect to K and each land from the head of Seo-gu, Seo-gu, Seocheon-si, in order to obtain the said building permit from the head of Seo-gu, Seo-gu (hereinafter “instant building permit”; and thereafter, obtained the instant building permit’s right based on the instant building permit (hereinafter “instant building permit”), and obtained the said permit for development activities as indicated in attached Form 2 “
(hereinafter the above development permit is referred to as “instant development permit,” and the right under the instant development permit is referred to as “instant development permit.”
Between April 1, 2013 and April 8, 2013, K was divided into 378 square meters, 244 square meters prior to the division, 187 square meters prior to theO, 312 square meters prior to the division, and Q 980 square meters prior to the division, and the land prior to the division was divided into 117 square meters prior to the division, 38 square meters prior to the distribution, 180 square meters prior to the distribution, 180 square meters prior to the distribution, and 787 square meters prior to the distribution, respectively.

In November 2013, M and Defendant C signed a letter of transfer and takeover (Evidence A 14) with respect to the transfer of the instant building permit and the instant development permit rights.
After that, Defendant C voluntarily takes the subject of permission on the change of the name of the construction participant and the development permission of this case with respect to the building permit of this case to the head of Seo-gu, Seocheon-si.
