Reasons
Punishment of the crime
[2014 Highest 935] Defendant BR was sentenced to two years of suspension of execution on February 26, 2014, for the following reasons: (a) Defendant BR was sentenced to two years of imprisonment with prison labor for alteration of official documents in the Goyang Branch of the District Court on February 18, 2014; and (b) the judgment became final and conclusive.
1. Defendant A operated a used car sales company (oil BX) in BW at the time of Gyeonggi-do. A.
The Defendant received a certain amount of fee from those who wish to distribute the “Stop” No. 1, and received a false registration of the transfer of the owner as if he/she purchased the car, etc. for business use from the said (TBX)BX with the vehicle for sale goods.
On March 2013, the Defendant received a proposal from BR to falsely register a vehicle, and the Defendant did not purchase a BY-ro vehicle for the goods of BY operated by the Defendant, as if he purchased the said vehicle, prepared a document of application for registration of transfer of the said vehicle to the name and poor in the office of registration of the owner of the said vehicle, and received approximately KRW 300,000 from BR, for the fee for the said vehicle.
In addition, on March 2013, the Defendant received approximately KRW 300,000 per vehicle as shown in the annexed Table 1, and made a false registration for the transfer of the 61 vehicle to the 61 vehicle, and received illegal money in relation to the automobile management business.
(b) Where a motor vehicle for sale as a used motor vehicle dealer is presented at the workplace, the dealer shall have the front registration number plate of the presented motor vehicle kept by the relevant motor vehicle sale business association or the head of the relevant Si/Gun/Gu, and where the motor vehicle has been sold or mediated for sale, the dealer may operate the motor vehicle with its front registration number plate attached only in the case of application for transfer;
