1. The defendant shall pay to the plaintiff KRW 30,000,000 as well as 5% per annum from November 24, 2004 to December 12, 2006.
Reasons
1. Indication of claim;
A. In the case of the claim for reimbursement filed by the Plaintiff against the Defendant as Daejeon District Court 2006Kadan82172, the above court rendered on January 12, 2007 the judgment that “the Defendant shall pay to the Plaintiff 30,000,000 won and interest calculated at the rate of 5% per annum from November 24, 2004 to December 12, 2006 and 20% per annum from the next day to the day of full payment” and the above judgment became final and conclusive around that time.
The Plaintiff has the interest in filing the instant lawsuit for the interruption of extinctive prescription of claims based on the foregoing final judgment.
B. Therefore, the defendant is obligated to pay to the plaintiff 30 million won and damages for delay calculated by applying 5% per annum from November 24, 2004 to December 12, 2006 and 20% per annum from the next day to the day of full payment.
