A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the representative director of Guro-gu Seoul Metropolitan Government D (hereinafter referred to as "D") in Guro-gu and 812.

The Defendant is a fund created with funds invested by government agencies, such as the Small and Medium Enterprise Promotion Foundation, in accordance with the Act on Special Measures for the Promotion of Venture Businesses from E, which was an employee of the Korea Venture Investment Association, from the Korea Venture Investment Association, and if a venture business that has met certain conditions in accordance with the aforementioned Special Measures and the operating regulations files an application for a re-titled investment with at least a certain amount of investment (or a premium increase method) from three diesel investors for the purpose of establishing the foundation for the promotion of start-up and supporting venture businesses, the Defendant became aware of the fact that a venture business falls under a venture business and three or more kinds of funds invested by the diesel investors are paid as investments (the method of acquiring new stocks) in a venture business.

Accordingly, the Defendant asked F, G, and H to lend the name of the investment fund and the investor to F, thereby providing a temporary loan from F, and pretending that F, G, and H will acquire shares issued with capital increase from D with the said funds. As such, the Defendant solicited F, G, and H to acquire the investment fund in the name of the acquisition price of new shares from the Reference Fund.

In fact, however, the amount of the investment 200 million won is extended to F in lump sum.
