The punishment of the accused shall be determined by two years of imprisonment.

The defendant shall complete the sexual assault treatment program for 40 hours.

Criminal facts

On January 28, 2016, the defendant and the person subject to a request to attach an attachment order (hereinafter referred to as "defendants") were sentenced to one year and two months of imprisonment with prison labor for a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Indecent Acts at Open Place) at the Seoul Eastern District Court on November 2, 2016. On September 27, 2018, the execution of the sentence was terminated at the Ansan Prison. On September 27, 2018, the defendant was undetained for an act of indecent acts committed by the original branch of the Chuncheon District Court and appealed for one year and two months of imprisonment with prison labor for the same crime at the same court on November 29, 2018, but the judgment became final and conclusive on June 5, 2019 after being sentenced to one year and two months of imprisonment with prison labor at the Chuncheon District Court on March 29, 2019.

The Defendant had been confined to B from June 7, 2018 to December 4, 2012 of the same year while he/she had been serving a prison in an original prison located in the Gangwon-si, Gangwon-do, Gangwon-do, from April 13, 2018 to January 11, 2019. The victim C (27 years of age) was confined to the above room from December 3, 2018 to December 7 of the same year. The victim D (31 years of age) was admitted to the above room from October 15, 2018 to December 12 of the same year.

From December 3, 2018 to December 22:00, 12:4, 00:30 of the following day, the Defendant committed the crime against the victim C, thereby enjoying the victim’s hand back from the main prison room B to the victim’s side, and thus committing an indecent act by force, by inserting the victim’s hand into the victim’s clothes, even though the victim rejected and rejected the Defendant’s hand away.

2. On October 15, 2018, around 22:00 on October 15, 2018, the Defendant committed the crime against the victim D, by inserting his/her hand into the panty of the victim D, who was in the head of the main correctional institution, and by inserting his/her hand, committed an indecent act against the victim by force.
