1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff’s husband’s husband’s net B (CB, hereinafter “the deceased”) is a person who has worked as a mining source in D from February 15, 1963 to November 30, 1968.
B. From January 14, 2008 to January 18, 2008, the Deceased was diagnosed as “ Pneumoconiosis-type disease type” in the diagnosis of pneumoconiosis conducted by the E Hospital from January 14, 2008, and was recognized by the Defendant as being eligible for medical care benefits under the Industrial Accident Compensation Insurance Act.
Accordingly, the deceased has received the above medical care benefits while being hospitalized in the F Hospital.
C. On December 5, 2014, the Deceased died at a F Hospital around 00:10 on December 5, 2014, and the direct death on the death diagnosis report is the respiratory part, the intermediate event is the pulmonary part, and the prior death is the pulmonary part, and the pulmonary part is the pneumoconiosis.
On March 10, 2015, the Plaintiff asserted that the deceased’s death constitutes occupational accidents caused by pneumoconiosis, and filed a claim for the payment of survivors’ benefits and funeral expenses to the Defendant on March 10, 2015. However, the Defendant determined that “the deceased’s death was under medical care due to pneumoconiosis (type 1) and high-level disability, and the direct death was determined as a result of aggravation of pulmonary life, and that the cause of pulmonary convergence was determined to have a significant impact on the terminal cancer rather than pneumoconiosis, and that the causal relationship between pneumoconiosis and death is low. In examining the medical records of the deceased’s Fa Hospital and the Ga National University Hospital Hospital Hospital, however, there is a possibility of death due to pneumoconiosis and pulmonary convergence, but the causal relationship between pneumoconiosis and pulmonary disease was lower, according to the medical opinion of the advisory branch of the Defendant Young-gu, determined on April 29, 2015.”
On July 15, 2015, the Plaintiff appealed and filed a request for examination to the Defendant, but was dismissed on September 24, 2015.
E. On March 29, 2016, the Plaintiff filed a claim with the Defendant for the payment of survivors’ benefits and funeral expenses, but the Defendant is the deceased on May 2, 2016.
