2. Defendant.

1. Basic facts

A. The Defendant Cooperative is a cooperative established by the persons selected as subjects of livelihood measures in relation to the L/C development project in Songpa-gu Seoul Special Metropolitan City, Songpa-gu, Seoul Metropolitan City, which was implemented by the Seoul Housing and Urban Corporation (hereinafter “Seoul Urban Corporation”), to carry out the business of purchasing commercial lots from Seoul Urban Corporation and newly constructing and selling commercial buildings (hereinafter “instant business”).

Defendant H Co., Ltd. (hereinafter “Defendant Company”) is a company for the purpose of real estate development and implementation business, etc., and Defendant I is the actual representative of the Defendant Company.

B. On March 12, 2012, the Defendant Union entered into a construction management service contract (hereinafter “instant service contract”) with the Defendant Company with the terms of entrusting all the affairs pertaining to the implementation of the instant project (hereinafter “instant service contract”).

C. From April 8, 2013 to June 2013, the Plaintiffs entered into an agreement with the Defendant Association and the Defendant Company as a member of the Defendant Association (hereinafter “instant agreement”), respectively, and received the certificate of payment of contributions under the name of the Defendant Association and the Defendant Company, respectively, after transferring the contributions to the bank account of the Defendant Company (hereinafter “members’ contributions”).

D. Of the articles of incorporation of an employee association, the provisions pertaining to qualifications are as follows.

[Articles of the Defendant Association] 5 (Qualification for and Admission to the Articles of the Association) (1) Members are selected by the Seoul Urban Corporation as persons eligible for livelihood countermeasures and submit all the documents requested by the Association, such as an application for joining the association.

(2) Additional members shall present themselves.
