A defendant shall be punished by imprisonment for not less than eight months.

The evidence seized shall be confiscated from the accused.

Punishment of the crime

1. Around May 2012, the Defendant violated the Customs Act: (a) visited Mawre in China, purchased 104 Chinese Mawre 104, and then, (b) requested D, a ship-satis residing in China, to import it into the Republic of Korea; and (c) requested D, a ship-satis in China, E, G, H, I, etc., to import it into a container; and (d) planned to import a container in a way of loading a container into a transshipment shipment, as if it were exported from China to Cambodia via Busan.

E On June 1, 2012, at the request of the Defendant, who is the actual owner, shipped one container into J, which is a disguised shipment line, as if the container was transshipped from China to Cambodia via Busan port, and as if the container was loaded into Busan port, on June 8, 2012, the said container was unloaded and brought into a bonded warehouse. Upon the loading of the container at J, which arrived at the Busan port located in the Nam-gu Busan port, Busan port, the said container was filed with the Busan Customs office with a false bonded transportation report stating that the goods were transshipped transshipment goods, and on June 15, 2012, the said container was not transported to the bonded warehouse, and the said container was recovered by moving the forged goods loaded in the said container to a L business place located in the Busan Si/Gun, Busan.

Accordingly, the Defendant imported 94 lux 104 total sum of 10 lux 10, the cost of goods 5,453,700 won without filing an import declaration.

2. 상표법위반 피고인은 위 1항과 같은 일시 및 장소에서 위 1항과 같이 위조상표가 부착된 로렉스 시계 17개, 태그호이어 시계 6개, 샤넬 시계 8개, 오메가 시계 3개, 브라이틀링 시계 11개, 프랑크밀러 시계 4개, 구찌 시계 16개, 휴블롯 시계 29개를 밀수입하여 합계 94개의 위조상표가 부착된 시계 정품시가 합계 1,379,000,000원 상당을 국내판매용으로 밀수입하고 소지하였다.
