1. The Defendants are to the Plaintiff:

(a) deliver the buildings listed in the separate sheet;

(b) Joint and several 1,624,700 won and December 2016.

Reasons

1. Facts of recognition;

A. On March 26, 2015, the Plaintiff purchased a building listed in the separate sheet (hereinafter “instant building”) from D for KRW 1.9 billion, and completed the registration of ownership transfer on April 27, 2015.

B. The Defendants received delivery of the instant real estate from the Plaintiff on April 27, 2015, and operated a restaurant in the said real estate.

C. On October 7, 2016, the Plaintiff sold the instant real estate at KRW 2.7 billion to the Jungdong Co., Ltd., and completed the registration of ownership transfer on October 25, 2016.

2. Determination as to the claim for extradition of the instant real estate

A. The summary of the party’s assertion (1) The Plaintiff concluded a lease agreement with the Defendants on a monthly rent of KRW 1,700 with the instant building, without a deposit. The said lease agreement was terminated due to the rental delay of the Defendants.

Even if the loan contract for use of the instant building was concluded between the Plaintiff and the Defendants, the said contract term expires, so the Defendants are obligated to deliver the instant building to the Plaintiff.

(2) The Defendants have the right to possess and use the instant building for the following reasons.

㈎ 피고 B은 원고에게 이 사건 건물을 명의신탁한 후 원고와 사이에 향후 피고 B이 원고로부터 이 사건 건물을 21억 원에 매수하기로 하고 위 매수시까지 사실상의 소유자로서 이 사건 건물을 사용하기로 약정하였다.

㈏ 피고들은 원고와 이 사건 건물에 대하여 반환시기의 정함이 없는 무상의 사용대차계약을 체결하였는데, 아직 반환시기가 도래하지 않았다.

㈐ 피고들은 원고의 동의를 받아 이 사건 건물의 1층을 증축하였는데, 위 증축공사비를 지급받을 때까지 이 사건 건물을 점유할 권리가 있다.

B. (1) Determination is based on the terms of a contract concluded between the Plaintiff and the Defendants.
