A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On July 2007, the Defendant was sentenced to a summary order of 6 months to a suspended sentence of 1 million won for the commission of an injury at the order of the Gwangju District Court of Gwangju on June 2007; on November 30, 2007, the Defendant was sentenced to a summary order of 700,000 won for the commission of an injury at the Suwon District Court; on March 19, 2009, the Defendant was sentenced to a fine of 2 million won for a violation of the Punishment of Violences, etc. Act (joint injury) at the Suwon District Court of Suwon District on March 17, 201; on June 17, 201, the Defendant was subject to a summary order of 500,000 won for a fine of 1.5 million won for a violation of the Punishment of Violences, etc. Act (joint injury) at the Suwon District Court of Suwon District on March 13, 2013; and was sentenced to a summary order of 500,000 won for a fine from the Suwon District Court.
2. The Defendant 2015 Highest 2757 sentenced the victim C (the age of 44) to the Defendant’s wife at ordinary times for a part of the money that was lost by gambling to the Defendant’s wife, namely, 3 million won of the money, and reported his/her success and gambling. The Defendant attempted to inflict injury on the victim.
At around 22:00 on April 11, 2015, the Defendant: (a) made two calls with the victim at a time in distress; (b) made fluencing “to throw away a bridge,” “to throw away it into a vehicle,” and (c) made the victim feel a fear by driving a Frop vehicle, which is a dangerous object of the victim’s alley in front of the E, located in Osan-si, Osan-si, on April 12, 2015; and (b) made the victim feel a fear by shocking two parts of the wall in front of the victim.
3. The Defendant: (a) took a bath and assaulted the victims on the ground that he did not lend money to the elderly while making a loan to, and did not repay the money in, the lux market located in the luxa-ro No. 272-ro 22, Osan-si; (b) was habitually inflicting injury on, the victims; and (c) assaulted and threatened them as follows.
On March 22, 2013, the Defendant extended money to the Victim H (52 years of age, 52 years of age) from the J's house located in I and II in O and II O.S. on March 2013.
