1. 이 사건 공소사실의 요지 피고인은 리그 오브 레전드(www. leagueoflegends. co. kr) 온라인 게임에서 아이디 ‘C’를 사용하는 사람으로서, 2014. 9. 25. 23:17경 김포시 D, 207동 1904호 소재 자신의 주거지에서 위 게임에 접속하여 피해자 E을 포함한 F 등 10여 명이 함께 게임을 하던 중 다른 게임참가자들이 보는 가운데 채팅창을 통해 피해자에게 “븅*신 잼0니요”, “병*신 E씨임 ㅋㅋ”, “니 애*미도 니 낳고 미역국 쳐드심 ”, “E아 시*발련아, 븅*신같이도 지었다 이름 참”이라는 등 욕설을 함으로써 공연히 피해자를 모욕하였다.

2. The facts charged in the instant case are crimes falling under Article 311 of the Criminal Act, and may be prosecuted only when the victim files a complaint pursuant to Article 312(1) of the Criminal Act.

According to the records, the facts that the victim revoked the complaint against the defendant on December 26, 2014, which was after the prosecution of this case was instituted, can be acknowledged. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
