A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person shall transfer or acquire a means of access in using and managing the means of access;

Nevertheless, the Defendant: (a) received a proposal from a person under whose name the Defendant: (b) “If he/she makes a corporate name account and send a passbook, physical card, and OTP card, he/she will give KRW 1.5 million to one account; (c) and (d) around July 12, 2018, the Defendant established a mutual legal entity, “B,” one of which, as Seoul Gangdong-gu, Gangdong-gu, Seoul, the two male and female under his/her name in front of the 1139 Gangwon-gu, Seoul, as the Gangdong-gu, Seoul, as the case may be, and delivered to the person under whose name the name the Defendant was named, via a passbook, physical card, and OTP card connected to the bank account (E) opened in the name of the said legal entity on July 23, 2018.

Accordingly, the Defendant transferred the means of access to others.

2. No one shall transfer or acquire any means of access in using and managing the means of access;

Nevertheless, the Defendant, on July 2018, under the contact with the deceased on the name of the deceased on the first time, opened a passbook and opened a passbook to the effect that “1,500,000 won per 1,000 won per 1,000 won per 1,000 won per 1,000 won.” On July 13, 2018, the Defendant: (a) opened a H Bank Cancer branch in Eunpyeong-gu, Seoul, and opened an account in the name of the said legal entity at the H Bank Cancer branch (Account Number I) around July 26, 2018; (b) opened the passbook and the OTP card in the name of the deceased on the same day; and (c) transferred the passbook and the OTP card to Kwikset service articles, each of whom was sent by the deceased on the same day by opening the bank account in the name of the said legal entity at the K Association Cancer Cancer branch in Eunpyeong-gu, Seoul.
